These Terms and Conditions apply to services provided by Utility Insight Solutions Ltd trading as Digsure Utility Mapping, Company No. 16112947, referred to throughout these Terms as “Digsure”, “we”, “us” or “our”.
By placing an order, accepting a quotation, making payment or using any report, utility pack, drawing or other information supplied by Digsure, the client agrees to these Terms and Conditions.
1. Our Services
Digsure provides desktop utility record searches and associated services, which may include:
- Basic Utility Searches
- Comprehensive Utility Searches
- utility record plans
- combined utility packs
- CAD utility drawings
- digitisation of utility records
- associated desktop utility information and reporting
The precise scope of each service is determined by the quotation, order confirmation, website product description or other written agreement provided at the time of order.
2. Desktop Utility Records Search Only
Unless expressly stated otherwise in writing, all Utility Searches supplied by Digsure are desktop utility record searches only.
They do not constitute a physical utility survey, site investigation, PAS 128 Type B detection survey or physical verification of underground or overhead apparatus.
Digsure obtains and compiles information supplied by utility companies, statutory undertakers, network operators, independent utility providers and other relevant third-party asset owners.
Digsure does not physically locate utilities on site as part of a desktop Utility Search.
3. Utility Plans Are Indicative Only
Utility records are provided as an indication of the known apparatus recorded by the relevant asset owner.
The position, depth, alignment, condition, ownership and status of apparatus shown on utility records cannot be guaranteed.
Utility records may be:
- incomplete
- inaccurate
- out of date
- incorrectly scaled
- based upon historical information
- missing recently installed or diverted apparatus
- missing abandoned or decommissioned apparatus
- missing private or unidentified networks
- missing individual service connections
The absence of apparatus from a utility plan must not be interpreted as confirmation that no apparatus exists.
4. Gardens, Driveways and Private Property
Clients should be particularly aware that utility company records do not always show all apparatus within private property boundaries.
Individual service connections and privately owned apparatus may not be shown, or may only be partially shown, within:
- gardens
- driveways
- yards
- car parks
- private roads
- development sites
- commercial premises
- agricultural land
- other privately owned land
For example, a water, gas, electricity or telecommunications plan may show a main within the public highway but may not show the individual service connection continuing from that main into a property.
A recorded route may also stop at, or close to, a property boundary even where the physical service continues beyond that point.
Private drainage, private water supplies, private electrical cables, communications cables and other owner-installed services may also be entirely absent from statutory utility records.
Clients must therefore never assume that a garden, driveway or other private area is clear of utilities simply because no apparatus is shown on the supplied plans.
5. Basic Utility Searches
A Basic Utility Search is a limited desktop search covering only the utility providers and records specifically included within the service purchased.
A Basic Utility Search does not constitute a search of every possible statutory, non-statutory, independent or privately owned utility provider.
Other asset owners may have apparatus within or close to the search area.
Where a more complete desktop investigation is required, the client should consider obtaining a Comprehensive Utility Search.
6. Comprehensive Utility Searches
The term “Comprehensive Utility Search” refers to the breadth of providers and records investigated.
It does not mean that Digsure guarantees that every utility, service connection, private network or item of apparatus present within or around the site will be identified.
Some asset owners may not provide records, may be unable to identify the requested location, may provide incomplete information or may require additional enquiries or charges.
Unrecorded and privately owned apparatus may also remain unidentified.
7. Affected and Unaffected Responses
Any classification of an asset owner as Affected, Potentially Affected, Unaffected, Clear or similar is based solely upon the records and responses available at the time of the search.
An Unaffected or negative response does not constitute confirmation that the ground is free from utility apparatus.
It means only that the information supplied by the relevant asset owner did not identify apparatus considered to affect the search area.
8. Physical Verification Before Works
Utility records supplied by Digsure must not be used as the sole basis for excavation, drilling, piling, trenching, demolition, directional drilling, construction or any other intrusive activity.
Before intrusive works take place, the actual position of underground services must be established on site using appropriate detection and verification methods.
Depending upon the nature of the project, this should include appropriate measures such as:
- a PAS 128 Type B utility detection survey
- Ground Penetrating Radar, GPR
- Electromagnetic Location, EML
- Cable Avoidance Tool, CAT, scanning
- service locating and marking
- visual site inspection
- carefully positioned trial holes
- safe hand digging
- consultation with the relevant asset owner
Where GPR and EML are appropriate to the site and proposed works, the desktop records supplied by Digsure must not be relied upon for excavation or construction without such on-site detection and verification having first been undertaken.
The client, contractor and persons carrying out the works remain responsible for determining the level of physical verification required.
9. HSG47 and Safe Working
All intrusive works must be planned and carried out in accordance with applicable legislation, recognised safe working practices and HSE guidance HSG47, Avoiding Danger from Underground Services.
Clients must also comply with any specific safety instructions, exclusion zones, permit requirements or working restrictions issued by individual asset owners.
Where overhead electricity apparatus is present, appropriate guidance relating to working near overhead power lines must also be followed.
10. Search Boundary
Digsure carries out searches based upon the boundary and project information supplied by the client.
The client is responsible for ensuring that the search boundary accurately covers the entire area in which works may take place.
If the development boundary, excavation area, access route, compound, haul road, connection route, construction area or design changes, additional searches may be required.
Digsure accepts no responsibility for apparatus located outside the boundary supplied by the client.
11. Third-Party Information
Utility records contained within our reports originate from third-party organisations.
Digsure does not create or maintain these records and cannot independently verify their accuracy, completeness, currency or positional accuracy.
Each utility plan remains subject to the disclaimers, copyright notices, validity periods and safety instructions imposed by the organisation that supplied it.
Where an asset owner provides no response, delayed information or incomplete records, Digsure cannot guarantee that the missing information will become available.
12. Record Validity and Updates
Utility infrastructure changes over time.
Records may become outdated following new connections, diversions, disconnections, reinforcement works or other network changes.
Clients must ensure that utility plans remain within any validity period specified by the relevant asset owner.
If works are delayed or the project changes materially, updated utility searches should be obtained before work commences.
13. CAD Utility Drawings
Where Digsure produces CAD drawings from utility records, the drawing is a graphical interpretation and coordination of the source information supplied by third-party asset owners.
Digitising or combining utility information into CAD does not improve the positional accuracy of the original source records.
Unless expressly stated otherwise, CAD utility drawings are not survey-grade drawings and must not be treated as physically verified utility locations.
Where discrepancies exist, the original asset-owner records and appropriate on-site investigation must be consulted.
14. Delivery Times
Any delivery time provided by Digsure is an estimate unless the service has expressly been sold as having a guaranteed turnaround.
Some utility companies and asset owners control their own response times and Digsure cannot be held responsible for delays outside our reasonable control.
Where part of a search remains outstanding, Digsure may provide available information first and issue outstanding records when received.
15. Client Responsibilities
The client is responsible for:
- supplying an accurate search boundary
- supplying sufficient site and project information
- reviewing the completed utility pack and all asset-owner notices
- ensuring information is passed to contractors and other relevant parties
- obtaining appropriate on-site utility detection and verification
- determining whether trial holes are required
- preparing suitable risk assessments and method statements
- obtaining any necessary permits and consents
- complying with HSG47 and asset-owner safety requirements
Possession of a Digsure Utility Search does not remove or reduce these responsibilities.
16. Fees and Payment
Fees will be confirmed through our website, quotation, order confirmation or other written agreement.
Unless otherwise agreed, all prices are exclusive of VAT.
Where third-party disbursements or additional asset-owner charges apply, these will be included within the agreed price or separately identified before being incurred where appropriate.
Work may not commence until payment has been received unless credit terms have been agreed in writing.
17. Cancellation and Refunds
Once Digsure has commenced placing utility enquiries, obtaining records, purchasing third-party plans or preparing project deliverables, costs may already have been incurred.
Cancellation and refund eligibility will therefore depend upon the stage reached when cancellation is requested.
Third-party charges and work already completed may be non-refundable.
Nothing within these Terms affects any statutory rights that cannot lawfully be excluded.
18. Liability
To the fullest extent permitted by law, Digsure accepts no liability for loss, damage, delay, cost, utility strike, service interruption or other consequence arising from or connected with:
- inaccurate, incomplete or outdated third-party utility records
- unrecorded apparatus
- incorrectly recorded apparatus
- private utility networks
- service connections not shown on utility plans
- apparatus within gardens, driveways or other private property that is not shown on provider records
- abandoned, diverted or subsequently installed apparatus
- reliance upon utility records without appropriate on-site detection and verification
- failure to undertake GPR, EML, CAT scanning, trial holes or other appropriate verification
- works undertaken outside the search boundary
- use of records beyond an asset owner's stated validity period
- changes to the utility network following completion of the search
- failure to comply with HSG47 or asset-owner safety instructions
- use of the information for a purpose for which it was not prepared
To the fullest extent permitted by law, Digsure will not be liable for indirect or consequential losses, loss of profit, loss of revenue, loss of opportunity, loss of contract, business interruption or project delay arising from reliance upon third-party utility information.
19. Legal Limitations
Nothing within these Terms excludes or limits liability where such liability cannot lawfully be excluded or restricted, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
Nothing within these Terms affects statutory consumer rights where those rights apply.
20. Intellectual Property
Utility plans supplied by third-party asset owners remain subject to their respective copyright and licensing restrictions.
Digsure reports, layouts, drawings and other original materials remain the intellectual property of Digsure unless otherwise agreed in writing.
Clients may use deliverables for the project and purpose for which they were supplied, subject to any third-party restrictions contained within the utility records.
21. Third-Party Reliance
Unless expressly agreed otherwise in writing, reports and drawings are prepared for the named client and specified project only.
No duty of care is accepted to any third party relying upon the information.
Where information is provided to contractors, designers or other project participants, those parties must read these Terms and all relevant asset-owner notices before relying upon the information.
22. Governing Law
These Terms and Conditions are governed by the laws of England and Wales.
Any dispute arising from these Terms or the services provided by Digsure will be subject to the jurisdiction of the courts of England and Wales, except where applicable consumer law provides otherwise.

Important reminder: A desktop Utility Search identifies recorded utility information only. It does not prove that the ground is clear. Utility records may not show individual services or privately owned apparatus, particularly within gardens, driveways and other private property. Appropriate on-site detection and verification, including GPR and EML where required, must be undertaken before intrusive works commence.
